The outstanding four-year divorce between Real Housewives star Bethenny Frankel and ex-husband Jason Hoppy seems to still have contentious issues that need to be resolved.

46-year old Hoppy appeared in court Tuesday on the account of harassment and stalking charges that Frankel pursued earlier this year. Hoppy’s lawyers revealed to PEOPLE that they filed a motion to dismiss the case, while Frankel’s attorney has yet to respond.

Hoppy was previously arrested on Jan. 27 after Frankel claimed he allegedly threatened her after showing up at their daughter’s school. It was confirmed that a restraining order was issued against him but Hoppy denied the charges and his former attorney released a statement saying, “There are no words to express how saddened Mr. Hoppy is over his ex-wife’s unjustified actions. His only concern is his daughter and intends to vigorously fight these false charges.”

After Tuesday’s additional charges, PEOPLE received a copy of the court documents where Frankel argued that Hoppy’s methods of communication “caused mental and emotional harm and caused me to fear for my safety.”

The documents reveal text messages and in-person communications toward Frankel and her current boyfriend. Frankel has been quite open as the divorce proceedings continue and was brought to tears in a recent episode of Real Hosuewives of New York when talking about the divorce. She stated, “My custody situation is over, my financial settlement is over, my apartment is sold, and yet I sometimes feel hopeless. And I sometimes feel like my ex is untouchable and I’m not going to be able to get out of this.”
