Almost a year has passed since former Bachelor star Chris Soules was involved in a tragic car accident that killed one of his neighbors, Kenny Mosher, in their hometown of Aurora, Iowa.
In a new development in the case, on Tuesday, February 6 the 36-year-old filed an appeal to ask the supreme court to drop the felony charge of leaving the scene of a fatal accident before the case goes to trial.
In April 2017 Soules was charged with a felony after the truck he was driving rear-ended a tractor being driven by 66-year-old Kenny Mosher, causing the tractor to flip into a ditch and seriously injure Mosher who was transported to a hospital where he later died.
Soules’ lawyers are arguing that the felony charge of leaving the scene should be dismissed because he did stop and call 911 and stayed on the scene until emergency responders who “assured they had the situation in hand.” His lawyers also pointed out that Iowa state law does not require drivers to remain on scene for police in the event of a fatal crash, but the state prosecutors are arguing that the law does state that.
The former Dancing with the Stars’ contestant’s legal team is stating that because Soules is a “public figure” an “unnecessary trial” could be even more “damaging.” “If Mr. Soules is forced to proceed to trial and then appeal, there would be no way to undo the publicity and restore Mr. Soules to his original position,” the lawyers state in court documents obtained by the Register. “Addressing this questionable and fundamentally unfair charge, given these facts, prior to trial, better serves the interests of justice.”
